Why Businesses Choose Arbitration in Dubai
The benefits of arbitration over litigation in the local Dubai courts are numerous for businesses located there:
-
Confidentiality: Arbitration proceedings and hearings are conducted in private (kept confidential). Under Article 33 of the UAE Federal Law No. 6 of 2018 on Arbitration, as amended by Federal Decree-Law No. 15 of 2023, specifically refers to confidentiality of hearing and the proceedings.
-
Enforceability: The UAE is a member of the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (1958). Therefore, arbitral awards seated in the UAE are enforceable in more than 170 countries. Arbitration is thus particularly appropriate in cross-border commercial relationships.
-
Party autonomy: In arbitration in the UAE, the parties can select their arbitrators, the seat of arbitration, language and rules of procedure. Such a degree of choice is not available in normal court proceedings.
-
Neutrality: Arbitration in cross‑border disputes removes any concern about a “perceived local-court advantage”. This is why international arbitration UAE is a neutral option for parties from different countries.
-
Specialist decision‑maker: In arbitration in UAE, the parties can choose arbitrators with commercial, technical or industry expertise. Their dispute is therefore decided by experts rather than general court judges.
-
Finality: Arbitral awards are final and binding. On limited grounds, they may be challenged under the UAE Arbitration Law. This minimises long appeals and allows business to close disputes faster.

Why Hiring an Arbitration Lawyer in Dubai Matters
A professional arbitration lawyer in Dubai helps you protect your position from day one and increase your chances of a successful resolution:
-
Correct Arbitration Clause: Poorly drafted arbitration clauses are one of the prime causes of dispute. Lack of clarity in the Seat of arbitration, governing law or numbers of arbitrators can lead to expensive procedural disputes before the actual commencement of arbitration. A Dubai arbitration lawyer will ensure your drafting is strict and enforceable under your business
-
Compliance With DIAC, DIFC, ADGM Rules: Different rules apply in each arbitration institution. For example: Under DIAC Arbitration Rules 2022, a “Request for Arbitration” has to be in compliance with the rules before the filing of the case. Any omission in documents or wrong filing can cause delay and additional costs in the case. Our DIAC arbitration lawyer will ensure correct completion of each step in the process.
-
Creating a Strong, Well-Supported Case: When dealing with arbitration in Dubai commercial arbitrations there are always technical documents, technical evidence, multiple nations, and complex contract provisions to deal with. An experienced arbitration lawyer in Dubai drafts clear documents, strong witness statements, and expert reports.
-
Safeguarding your position on Costs: Under Article 36 of the DIAC Arbitration Rules 2022, tribunals can award legal costs. A well‑represented party is able to recover a large part of its fees. A skilled arbitration lawyer in Dubai helps you plan your strategy, avoid procedural mistakes, and reduce the risk of an adverse costs order in UAE arbitration.
-
Enforcing or challenging an Arbitral Award: Under Article 36 of the DIAC Arbitration Rules 2022, tribunals can award legal costs. A well‑represented party is able to recover a large part of its fees. Winning an arbitration award is only the first step. Enforcement of the award requires that the UAE courts ratify the award. If the losing party owns assets in other countries, enforcement in other countries may be required under the New York Convention 1958.
-
An arbitration lawyer in Dubai experienced in enforcement will enforce and advise on the best jurisdictions and respond to any challenges to the award.

Frequently Asked Questions (FAQs)
Q1. Can I enforce an English arbitration agreement in the UAE?
Yes. The Federal Arbitration Law in the UAE allows parties to select the arbitration language. In commercial arbitration disputes in Dubai, English is commonly used in DIAC and DIFC‑seated arbitrations. UAE courts routinely consider and enforce English arbitration clauses.
Q2. Can I seek interim relief from UAE courts during arbitration?
Yes. Article 18 of the Federal Arbitration Law allows parties to seek interim relief from UAE courts before or during arbitration. For example, when urgent action is needed to preserve assets or evidence before the arbitration starts.
Q3. How long does it take for arbitration in Dubai?
The arbitration time in Dubai depends upon the complexity of case, value, and cooperation of the parties.
- For simple or low-value disputes, the average time is about 9–15 months.
- For complex or high-value disputes, it may be 12–24 months and sometimes 18–36 months.
Under the DIAC Rules 2022, the tribunal must render the final award within 6 months from the time the file is received. In a fast-track procedure (disputes not exceeding AED 1,000,000), a sole arbitrator must render the award within 3 months, with only limited extensions.
Q4. What happens if the other party refuses to show up to the arbitration?
Under Article 32 of the Federal Arbitration Law, if one of the parties fails, without a valid excuse, to appear at a hearing, to submit the required documents, or to carry out any procedure, the Arbitral Tribunal may continue the arbitral proceedings.
It can conclude the proceeding, and issue an award on the dispute, based on the available evidence. Proper notice is very important to secure enforcement of the award.
Q5. Can a free zone company participate in DIAC arbitration?
Yes. Free zone companies in JAFZA, DMCC and DSO use DIAC arbitration regularly. According to DIAC Arbitration Rules 2022, if the parties have not agreed on the seat of arbitration, the initial seat shall be the Dubai International Financial Centre (DIFC).
However, the seat shall ultimately be determined by the arbitral tribunal after taking into account the submissions of the parties and all other circumstances.
